These Terms & Conditions (“Terms”) govern your access to and use of the Access Behavior Analysis LLC (“ABA,” “we,” “us,” or “our”) website and mobile application (together, the “Services”). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Services. The Services are intended for professionals and adult learners.
2. Accounts
You are responsible for the information you provide and for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
3. Courses, CEUs & Certificates
We provide educational content, continuing education units (CEUs), workshops, and related certificates. Completion requirements (such as passing scores on exams) must be met to earn a certificate. We do not guarantee that any CEU or certificate will be accepted by any specific certifying body, employer, or jurisdiction; it is your responsibility to confirm applicability.
4. Purchases & Payments
Prices are shown at checkout and may change. Payments are processed securely by our third-party processor, Stripe; by purchasing, you authorize the applicable charge. You agree to provide accurate billing information. Applicable taxes may be added.
5. Workshops & Registrations
Workshop availability, dates, pricing tiers, and seats are subject to change until confirmed. Where a workshop has date-based pricing tiers, the price in effect at the time of registration applies. We may reschedule or cancel a workshop; in that event we will make reasonable efforts to notify registrants and, where applicable, offer a refund or credit.
6. Refunds
Unless otherwise stated at the point of sale or required by law, digital products, completed courses, and issued CEUs/certificates are non-refundable. For workshops cancelled by us, refunds or credits will be handled as described above. To request a refund, contact [email protected].
7. Acceptable Use
You agree not to:
- Copy, resell, share, or redistribute course content or exam materials;
- Share your account or certificates with others or misrepresent completion;
- Interfere with or disrupt the Services or attempt to gain unauthorized access;
- Use the Services for any unlawful, infringing, or fraudulent purpose;
- Upload harmful code or content that is abusive, defamatory, or infringing.
8. Intellectual Property
The Services and all content, including courses, materials, text, graphics, logos, and software, are owned by ABA or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access purchased content for your own personal, non-commercial educational use. All other rights are reserved.
9. User Content
You retain ownership of content you submit (such as reviews or ratings), and you grant us a worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Services. You are responsible for the content you submit and represent that you have the rights to share it.
10. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that content is accurate or complete. Educational content is for informational purposes and is not professional, legal, or medical advice.
11. Limitation of Liability
To the maximum extent permitted by law, ABA and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the product or service giving rise to the claim in the twelve months preceding the claim.
12. Termination
You may stop using the Services at any time and may request account deletion as described in our Privacy Policy. We may suspend or terminate your access if you violate these Terms or for any lawful reason. Provisions that by their nature should survive termination will survive.
13. Governing Law
These Terms are governed by the laws of the United States and the state in which Access Behavior Analysis LLC is organized, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located there, except where prohibited by applicable law.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
